AI Chat Roleplay - Terms of Service

1. Agreement to Terms

By downloading, installing, or using the AI Chat Roleplay mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and AI Chat Apps LLC ("Company," "we," "us," or "our").

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App following any changes constitutes acceptance of those changes.

2. Age Requirements and Parental Consent

Minimum Age: You must be at least 13 years of age to use this App. By using AI Chat Roleplay, you represent and warrant that you are at least 13 years old.

Parental Consent for Minors: If you are between 13 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and has consented to your use of the App. Parents and guardians are responsible for supervising their minor's use of the App and ensuring compliance with these Terms.

Children Under 13: This App is not intended for children under 13. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). If we discover that a user is under 13, we will immediately terminate their account and delete all associated data.

3. Description of Service

AI Chat Roleplay is a character-based roleplay chat application that uses artificial intelligence to generate interactive story responses. Users can create and interact with AI-powered characters in creative, age-appropriate storytelling scenarios including:

  • Fantasy adventures and quests
  • Science fiction stories
  • Mystery and detective narratives
  • Friendship and social scenarios
  • Educational role-playing
  • Creative writing exercises

The App is intended for entertainment, creative expression, and educational purposes only.

4. Content Standards and Prohibited Content

AI Chat Roleplay is designed as a safe, family-friendly platform. Sexual content is strictly prohibited.

Prohibited Content includes, but is not limited to:

  • Sexual or Adult Content: Any sexually explicit, suggestive, or romantic content intended for adults. This includes nudity, sexual acts, sexual solicitation, or sexually suggestive dialogue.
  • Violence and Gore: Graphic violence, torture, gore, or content that glorifies violence against people or animals.
  • Harassment and Bullying: Content that harasses, threatens, intimidates, or bullies any individual or group.
  • Hate Speech: Content promoting hatred, discrimination, or violence based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin.
  • Illegal Activities: Content promoting, encouraging, or depicting illegal activities including drug use, weapons, or criminal behavior.
  • Self-Harm: Content promoting or glorifying self-harm, suicide, or eating disorders.
  • Personal Information: Sharing personal information about yourself or others, including real names, addresses, phone numbers, or school names.
  • Impersonation: Impersonating real people, including celebrities, public figures, or private individuals.

We employ automated content moderation systems and human review to enforce these standards. Violations may result in content removal, account suspension, or permanent termination without notice or refund.

5. AI-Generated Content Disclaimer

All character responses and content generated by the App are produced by artificial intelligence systems. You acknowledge and agree that:

  • AI-generated content may occasionally be inaccurate, unexpected, or unsuitable despite our content filters
  • The AI does not have real feelings, consciousness, or understanding
  • AI responses do not represent the views or opinions of AI Chat Apps LLC
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • AI characters are entirely fictional and should not be treated as real entities
  • The AI may occasionally produce content that bypasses our filters; please report such instances immediately

Reporting Inappropriate Content: If you encounter any AI-generated content that violates our content standards, please report it immediately using the in-app reporting feature or by contacting us at support@roleplayai.chat.

6. User Conduct and Responsibilities

You retain ownership of content you create within the App. However, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide and improve our services.

You agree to:

  • Use the App only for lawful, age-appropriate purposes
  • Provide accurate information about your age
  • Keep your account credentials secure and confidential
  • Report any inappropriate content or behavior you encounter
  • Respect other users and the AI characters
  • Comply with all applicable laws and regulations

You agree NOT to:

  • Attempt to bypass content filters or safety measures
  • Create, share, or solicit any sexual, violent, or harmful content
  • Use the App to harm, exploit, or endanger minors in any way
  • Harass, threaten, or impersonate real individuals
  • Reverse engineer, hack, or compromise the App's security
  • Use automated systems, bots, or scripts to access the App
  • Share your account credentials or allow others to access your account
  • Use the App for any commercial purpose without our written consent

7. Subscriptions and Payments

The App offers optional subscription-based premium features. By purchasing a subscription, you agree to the following:

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple ID Account Settings after purchase
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription
  • Prices are in USD and may vary by region; prices are subject to change with notice

Refunds: Refund requests are handled by Apple according to their App Store policies. We are unable to process refunds directly. Visit Apple's support page for refund requests.

Minors and Purchases: If you are under 18, you must have your parent or guardian's permission before making any in-app purchases. Parents can enable purchase restrictions through Apple's Screen Time settings.

8. Account Termination

Termination by Us: We reserve the right to suspend or terminate your account immediately, without prior notice, for:

  • Violation of these Terms, especially content policy violations
  • Conduct harmful to other users or the community
  • Providing false information about your age
  • Attempting to bypass safety measures or content filters
  • Any other reason we deem necessary to protect our users or service

Termination by You: You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

Effect of Termination: Upon termination, your right to use the App will immediately cease. Active subscriptions terminated for Terms violations are not eligible for refunds.

9. Intellectual Property

The App, including its design, features, logos, graphics, and content (excluding user-generated content), is owned by AI Chat Apps LLC and protected by copyright, trademark, and other intellectual property laws of the United States and other countries.

You may not:

  • Copy, modify, or distribute the App or its content
  • Create derivative works based on the App
  • Use our trademarks or branding without written permission
  • Remove any copyright or proprietary notices

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL ALWAYS COMPLY WITH OUR CONTENT STANDARDS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI CHAT APPS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless AI Chat Apps LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you create or submit through the App
  • Any misrepresentation regarding your age

13. Dispute Resolution

Informal Resolution: Before filing any formal legal claim, you agree to contact us at legal@roleplayai.chat to attempt to resolve the dispute informally.

Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules. Arbitration shall take place in Alpharetta, Georgia, or may be conducted remotely. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exception: Either party may seek injunctive relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Fulton County, Georgia.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us in the App, constitute the entire agreement between you and AI Chat Apps LLC regarding your use of the App and supersede all prior agreements and understandings.
